Terms of Service

These Terms of Service ("Terms") govern your access to and use of Loan SmartR ("Service"), a marketplace that connects borrowers with licensed mortgage loan officers ("LOs"). By creating an account you agree to these Terms.
1. Eligibility
You must be at least 18 years old and a U.S. resident. Loan officers must hold a valid NMLS registration and the state licenses required to originate loans in the states they serve.
2. The marketplace
Loan SmartR is a discovery and quote-comparison platform. We do not originate, underwrite, fund, or service mortgages. Quotes are non-binding until you sign a written agreement directly with the loan officer or their lender.
3. Account responsibilities
You are responsible for maintaining the confidentiality of your credentials and for all activity on your account. Notify us immediately of any unauthorized use.
4. Accuracy of information
You agree to provide accurate, current information. Submitting false or misleading information (including unlicensed loan-officer activity) may result in immediate account termination.
5. Fees
Loan SmartR is free of charge for borrowers. Loan officers are not charged fees to participate in the marketplace. If fee structures are introduced in the future, they will be disclosed and agreed to in writing before taking effect.
6. Prohibited conduct
You agree not to: (a) scrape, reverse engineer, or interfere with the Service; (b) submit quotes you cannot honor; (c) misrepresent your identity, license status, or affiliation; (d) use the Service for unlawful, deceptive, or discriminatory purposes (including violations of the Equal Credit Opportunity Act or Fair Housing Act).
7. Disclaimers
The Service is provided "as is" without warranties of any kind. Loan SmartR is not a lender, broker, or fiduciary, and is not responsible for the actions of any third-party loan officer or lender.
8. Limitation of liability
To the maximum extent permitted by law, Loan SmartR's aggregate liability arising out of these Terms will not exceed one hundred U.S. dollars (USD $100).
9. Termination
We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time from your profile settings.
10. Governing law
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles.
